Dear Jillian Meyers-Brittain (Fair Trading assistant regional manager)
Thank you for the reply that appears to be completed just one day after my message of 29th January 2015.
It would appear that both Fair Trading and Kmart have no intention of exercising their duty of care, nor have either organisations attempted to answer my concerns/questions in relation to this matter.
There should be no argument that Kmart's warning label in relation to the chair in question was inadequate (see attached NUMBER1)
I specifically bought this chair for out door use, however under the safety standard that Kmart said applied this was never intended to be used outdoors.
EN 12520:
"It does not apply to ranked seating, seating for non-domestic use, office work chairs, office visitors chairs, chairs for educational institutions, outdoor seating..."
The attached warning label (NUMBER 1) offers no such warning.
Why not?
Fair Trading informed me that Kmart compliance officer Ms Assimakopoulos stated the following in relation to my complaint: "Ms Assimakopoulos advised these particular folding chairs can be used indoors and outdoors however if the chair begins to rust due to the conditions in which it was stored, Kmart are unable to guarantee that the condition of the chair would be fit for purpose over time."
This explanation does not comply with the Standard EN12520 which clearly states the chairs are not to be used outdoors.
In your letter of 30 January you wrote:
"Having reviewed all information and documents provided, I can confirm that all appropriate actions have been conducted in accordance with Fair Trading’s complaint handling policies and procedures."
Jillian, In relation to the above what are the appropriate actions or tests that were applied to the compliance and public safety concerns to my complaint?
Also, Fair Trading has chosen not to address my public/customer safety concerns in relation to this matter nor has Fair Trading attempted to answer the following questions posed by me on 29th January:
1 - Did or did not Kmart claim the chair was sold under international standard BS EN 12520?
2 - Does not international standard BS EN 12520 state clearly that it does not apply to outdoor seating?
3 - Should Kmart's waring label have warned customers these chairs are not to be used or stored outdoors?
3 - If the above is true then why did you accept Ms Assimakopoulos's claim that the chair can be used outdoors, when in fact international standard BS EN 12520 does not apply to outdoor seating.
4 - If Ms Assimakopoulos's claim is true in respect that the chair can be used outdoors then what safety standard is applicable - as BS EN 12520 does not apply to outdoor seating?
5 - Ms Assimakopoulos claims that if rust appears due to the conditions it is stored then under what storage conditional would make such a chair rust?
6 - These were the questions that Ms Assimakopoulos should have been asked - why wasn't she?
7 - Are you now willing to ask Ms Assimakopoulos the above questions?
As I feel these are valid questions one might ask why have you not attempted to have Kmart address them?
Jillian would you kindly forward this email to your Regional Manager and request a reply to my concerns.
Please note that to the best of my knowledge Kmart have yet to issue a warning or recall in relation to their negligence regarding the warning label; meaning customers are still at risk of unnecessary injury, something that you are now fully aware of.
My final question to you is:
Why is it you refuse to honour your duty of care in relation to the safety of Kmart customers?

As a current and soon to be former worker at West Anaheim (store closing March 2016) I have to say that yes Kmart has lots of problems and in a few years or less it won't matter because the company will be gone.
Corporate doesn't seem to be able to get with the times and improve the stores, training and recruit good workers.
What do you expect to get for minimum wage? How do you expect to retain your full-time leads when you don't even give them a raise or any incentives. How can you run a store when you cut hours back to the bare minimum? Most of these new kids that get hired in don't want to work and expect everything to be handed to them.
I've tried to guide some of these kids and tell them that while the pay sucks your the one who accepted this job so you need to give it 100%.
I've met a lot of good people (customers and co-workers) over the years at the six stores I've worked at and that is what I will truly miss because this will be my last retail gig.
For the record Gus is a huge improvement over Peter who did nothing but sit in his office and talk down to the employees and yell at you for not selling enough smart plans. Gus is on the sales floor working with you side by side, taking the time to explain how things work, how to do things better and taking care of the customers.
Eddie while he had his flaws (we all do) and wasn't a team player I have to admit that he trained his people well and he worked his butt off.
Finally to Michelle our District Manager. You really need to get on meds because you have to be bipolar. You also really need obtain some people skills because you do not have to instill fear and degrade people to get them to do a good job for you.
The way you yell and talk down to people on the sales floor is deplorable. Just remember Michelle one day it will come full circle back to you and you will be the one getting the pink slip and being escorted out of the store.
Good-luck Kmart I truly do hope someone up in Corporate wakes up sees the light but I wont hold my breath.
As a former worker at the West Anaheim Kmart, working retail was good experience and a stepping stone to my current job. The customers were great and coworkers as well (except for the gossiping).
However, I must say that management preach a false culture; they don't stand by what they preach, for they rather try to use culture values to exploit the workers. Also, management is never in sync, for the assistant managers do not respect Gus. Gus tells them to do business a certain way but instead they do it their way, which confuses and disrupts work performance. They contradict themselves.
They lack LEADERSHIP, COHESION, and COMMUNICATION which explains their lack of constructive feedback. Needless to say, they expect too much for mediocre pay. For example, one worker is assigned three different departments in a shift and is expected to have the depts. spotless clean.
When West Kmart obtains solid workers they do not appreciate nor value great performance. It's just a mess at that Kmart store. I sympathize the current workers but, if they want a better job, get an education!
Do not waste your time there! It's not worth working at a mediocre retail store with an incompetent management.
Heads up: Gus needs to own his role and Eddie needs to quit envying the female workers.
I think Eddie is the BEST. He's the nicest and hard working manager there.
Must admit that some of the service desk people there are lazy and don't deserve to be there. I'm also glad that the other person didn't get that promotion.
Maybe the service desk supervisor had customer complaints against her? Or the hours wouldn't work for her so she turned it down.
Maybe the young fellow had a degree that gave him a heads up. Maybe his parents owned a business so he had years of retail experience. Maybe there is an investigation going on with the female. Maybe she had a conflict of interest.
There are way to many maybe's for this to automatically be called a sexual discrimination case and as a third party nosy rosy, you will probably never know the whole story. Unless, of course, you are the supervisor that was passed up for the job?
Or maybe unlike the OP he knows how to spell simple first grade words?

If your work ethics are as terrible as your spelling and grammar he has every right to tell you that you are not doing your job properly. Stop playing the he is a big man and I am a poor defenseless woman ***, it makes you look like a two year old throwing a temper tantrum.
If you knew what you were doing he would not be having to tell you that you are doing wrong. I think you are just jealous that someone younger than you is your boss. Why else would you mention his age? Stop playing the sex discrimination ***.

You do not understand, once I got angry with him. i was so angry with him that i falsely claimed he sexually harassed me.
I told some people I trusted that it never happened. They told the people doing the investigation and I was written up for making the false claim. They said that I am lucky he is not pressing charges. He makes me so angry that I have to make up lies to get him fired.
That is how he annoys me. I am educated, I know very well what I am doing. I am doing a good job.
He treats me like I am uneducated and he is not that easy to work with. Like I said if you met him you would understand.
